Pclinkup provides managed IT support, cybersecurity services, backup and disaster recovery, and related technology solutions to small and medium-sized businesses. Specific services are detailed in individual service agreements.

Acceptable Use

Intellectual Property

Client Responsibilities

As a client, you agree to:

• Maintain the confidentiality of account credentials
• Promptly notify us of any security breaches
• Cooperate with our staff to facilitate service delivery
• Make timely payments for services rendered

Payment Terms

Payment terms are specified in individual service agreements. Generally:

• Managed services are billed monthly in advance
• Project work may require deposits or milestone payments
• Late payments may result in service suspension
• Prices may be adjusted with 30 days' notice

Warranties and Disclaimers

We strive to provide high-quality services but cannot guarantee uninterrupted or error-free service. OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PCLINKUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF OUR SERVICES.

Indemnification

You agree to indemnify and hold Pclinkup harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of our services.

Confidentiality

We will maintain the confidentiality of your proprietary information and data in accordance with our Privacy Policy and applicable service agreements.

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of material changes.

Termination

Either party may terminate services according to the terms outlined in the service agreement. Upon termination:

• You remain responsible for all fees incurred prior to termination
• We will assist with data transition (fees may apply)
• Certain provisions of these Terms survive termination

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If unresolved, disputes shall be governed by the laws of New Jersey and resolved in the courts of New Jersey.

Emergency Services

While we offer 24/7 monitoring and emergency support, response times may vary. Critical infrastructure should have redundancies and not rely solely on our services.

Data Backup

Although we provide backup services, you remain responsible for maintaining your own backup copies of critical data. We are not liable for data loss.

Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.
